These Terms and Conditions govern access to and use of the services offered by Ancillotti Alcide SRL (Hotel La Magione) and its affiliates through their online channels. By using the websites, you agree to these terms. If you disagree, you should not register or access the services.

Hotel La Magione is not responsible for the accuracy of user-generated content, which remains the user’s responsibility. It reserves the right to remove content that may damage its image or infringe third-party rights.

Restrictions on Use of Services

Users must not use Hotel La Magione’s websites to upload illegal content, spam, or attempt to breach the site’s security. The use of automated tools without authorization is prohibited.

Registered User Responsibility

The user guarantees that the information provided during registration is accurate and agrees to keep it updated. Hotel La Magione may suspend or terminate access if the information is incorrect. The user is responsible for the use of their credentials and must promptly report any breach.

User Protection

For complaints regarding purchased services, the user can complete the online support form. In case of dissatisfaction, the European Commission’s ODR platform can be used for dispute resolution.

Exclusion of Warranty and Liability

Hotel La Magione provides its services “as is” and “as available,” without any warranties, express or implied. The user uses the services at their own risk. Hotel La Magione does not guarantee the absence of errors or the completeness of information, nor is it liable for damages resulting from the use of its websites.

Limitation of Liability

Hotel La Magione and its affiliates will not be liable for direct, indirect, incidental, or consequential damages arising from the use of the services, including loss of data or profits. The total liability will be limited to the amount paid by the user in the 12 months preceding the incident.

User Responsibility

The user agrees to defend and indemnify Hotel La Magione for any damage arising from actions that violate the Terms and Conditions or the law.

Miscellaneous

The Terms and Conditions cannot be transferred by the user. If any clause is deemed invalid, the others will remain valid. Hotel La Magione may seek damages for violations of the Terms and Conditions.

Cancellation Conditions

Standard booking: free cancellation within 8 days before arrival; after this period or in case of no-show, the full amount will be charged.
Non-refundable pre-paid booking: cancellation is always penalized as payment is non-refundable.

Governing Law and Jurisdiction

These Terms and Conditions are governed by Italian law. For disputes, if the user is not a consumer, the competent court is in Siena. If the user is a consumer, the provisions of Legislative Decree 206/2005 apply.
